- Definitions
- “Business” refers to Guided Wild Africa
- “Client” refers to any participant or Website user
- “Adventure” refers to any expedition, safari, tour, or activity offered by the Business
- “Website” refers to the Business’s official website
- “Itinerary” refers to any itinerary, whether manual or electronic, including the Guided Wild Interactive Itinerary or Website content
1. Disclaimer, Risk & Indemnity
1.1 Participation and risk acceptance
Participation in all Adventures is voluntary and involves inherent risks associated with overland travel, remote environments, wildlife areas, variable road conditions, weather, and outdoor activities.
By booking or participating in an Adventure, the Client acknowledges and accepts these risks.
The Business will take reasonable care at all times to operate safely and responsibly.
1.2 Responsibility for personal loss or injury
The Client understands that travel in remote regions carries inherent risks that cannot always be eliminated.
To the extent permitted by South African law, the Client agrees that the Business, its staff, and representatives will not be held responsible for:
- ordinary travel-related injury, illness, or loss
- damage or loss of personal property
- delays or disruptions caused by external conditions
This does not exclude liability where the Business is found to have acted negligently or unlawfully.
1.3 Health and fitness
The Client confirms that they are medically fit to participate.
Any pre-existing medical conditions must be disclosed at the time of booking. Clients are responsible for bringing all required medication and managing their own health during the Adventure.
1.4 Vehicle responsibility (self-drive participants)
Clients using their own vehicles are responsible for ensuring their vehicle is:
- roadworthy
- properly maintained
- appropriately equipped for off-road and remote travel conditions
- adequately insured
The Business may provide guidance, but final responsibility remains with the Client.
2. Booking Procedure & Payment
2.1 Quotations are valid for 14 days unless otherwise stated.
2.2 A booking is confirmed once the required deposit reflects in the Business’s account.
2.3 Final travel details and itinerary documents are issued once full payment and required booking documentation are received.
2.4 Payment of a deposit and/or submission of a booking form constitutes acceptance of these Terms and Conditions, provided the Client has had a reasonable opportunity to review them.
3. Client Obligations During the Adventure
3.1 Clients must comply with reasonable instructions from Adventure Leaders at all times for safety and operational reasons.
3.2 The Business reserves the right to remove a Client from an Adventure if their behaviour, illness, intoxication, or conduct places themselves or others at risk. No refund will be due for unused services in such cases.
3.3 Clients agree to act responsibly and not intentionally damage the reputation of the Business through unlawful or abusive conduct.
4. Changes to Itinerary
4.1 Operational flexibility
The Business operates in remote and dynamic environments. It may be necessary to adjust routes, timing, accommodation, border crossings, or activities due to:
- weather conditions
- road or infrastructure issues
- wildlife movements
- safety concerns
- border delays or regulatory changes
- operational requirements
We will always aim to maintain the overall quality and intent of the Adventure.
4.2 Material changes
If a change significantly alters the core nature of the Adventure, the Client will be offered the option to:
- accept the revised itinerary, or
- transfer to an alternative Adventure (subject to availability)
5. Communication
5.1 Clients consent to communication via electronic means, including email and messaging platforms.
5.2 Communications are deemed received once they are reasonably accessible to the recipient.
5.3 Response times may vary during active Adventures due to operational conditions.
6. Pricing
6.1 Pricing is prepared in good faith, but errors or omissions may be corrected.
6.2 Prices may change due to factors outside the Business’s control, including fuel costs, exchange rates, supplier pricing, park fees, and border charges.
Where a price increase materially affects a confirmed booking, the Client will be informed and offered the option to proceed or cancel.
6.3 Unless otherwise stated, park fees and third-party charges may be excluded from the Adventure price.
6.4 Clients acknowledge that pricing may vary across seasons and years due to inflation and operational changes.
7. Cancellation by the Business
7.1 The Business may cancel an Adventure due to insufficient bookings. Clients may transfer or receive a refund of amounts not yet committed to non-recoverable costs.
7.2 Force majeure (external events)
The Business may postpone, amend, or cancel an Adventure due to events beyond its control, including:
- extreme weather or natural disasters
- political instability or unrest
- border closures or government restrictions
- epidemics or public health emergencies
- infrastructure failure or major transport disruption
In such cases, Clients will be offered a transfer or refund of any recoverable amounts, excluding costs already committed on their behalf where non-refundable.
7.3 Business limitation of liability
The Business is not responsible for indirect costs such as flights, visas, accommodation, or independently booked services. Clients are strongly advised to obtain comprehensive travel insurance.
8. Cancellation by the Client
8.1 Cancellation terms apply as set out in the quotation.
8.2 Cancellation fees reflect costs already incurred and commitments made on behalf of the Client.
8.3 Early departure from an Adventure results in no refund for unused services, and the Client is responsible for their onward arrangements.
9. Travel Documentation
Clients are responsible for ensuring they hold valid:
- passports
- visas
- vaccinations (where required)
- permits and entry documentation
- currency and payment means
The Business accepts no liability for delays or losses arising from incomplete documentation.
10. Insurance
10.1 Clients are required to hold appropriate travel and medical insurance covering the full duration of the Adventure.
10.2 Insurance should include medical treatment, evacuation, repatriation, cancellation, baggage, and vehicle cover where applicable.
10.3 The Business does not verify insurance and cannot be held responsible if coverage is inadequate.
11. Website & Intellectual Property
11.1 The Website is provided as an information platform. While reasonable care is taken, the Business does not guarantee uninterrupted access or error-free content.
11.2 The Business is not liable for:
- website interruptions or technical issues
- third-party website content
- viruses or malicious code
11.3 Website content is for personal use only and may not be copied or commercially reused without permission.
12. Recovery, Equipment & Field Operations
12.1 Clients acknowledge that overland travel may involve recovery operations and challenging conditions.
12.2 Any recovery assistance is provided in good faith for operational safety. The Business is not liable for loss or damage arising from reasonable recovery actions.
12.3 Clients may be charged for damage, misuse, or replacement of Business equipment where caused by negligence or misuse.
13. Photographs & Media
13.1 The Business may capture photos and video during Adventures for marketing purposes.
13.2 Clients who do not wish to appear must notify the Business in writing before departure.
14. Privacy (POPIA)
14.1 Personal information is collected to manage bookings, operations, communication, and legal compliance.
14.2 By booking, Clients consent to the use of their information for these purposes.
14.3 Personal data will not be sold and will only be shared where necessary for operational or legal reasons.
15. Governing Law & Disputes
15.1 These Terms are governed by the laws of the Republic of South Africa.
15.2 Any dispute will first be attempted to be resolved directly. If unresolved, it may be referred to arbitration under the Arbitration Foundation of South Africa (AFSA), unless prohibited by applicable consumer protection law.
16. General
16.1 The Business may update these Terms periodically. The latest version will always apply to new bookings.
16.2 Continued participation in an Adventure confirms acceptance of operational Terms in effect at the time of travel.
16.3 Clients may not misuse Website content or introduce malicious code.
16.4 All intellectual property remains the property of the Business.
16.5 Clients may not transfer bookings without written approval.
